Terms of Use
1. Acceptance of Terms
By accessing or using this API ("the API"), you ("Developer" or "User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the API. These Terms constitute a binding legal agreement between you and the API Provider ("we," "us," or "our").
2. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, royalty-free license to access and use the API solely for lawful purposes and in accordance with these Terms and any accompanying documentation.
3. Registration and API Keys
You will be required to register to obtain an API key to access the API.
You are responsible for maintaining the confidentiality of your API key and for all activity that occurs under it.
You must not share, sell, transfer, or sublicense your API key to any third party.
We reserve the right to revoke your API key at any time, with or without notice, for violation of these Terms.
4. Permitted Use
You may use the API to:
Access and retrieve content for personal, educational, research, or commercial application development.
Build applications, tools, or services that integrate the API, provided they comply with these Terms.
Cache API responses for a reasonable period, consistent with any caching headers or documentation guidelines.
5. Prohibited Use
You may not use the API to:
Violate any applicable local, national, or international law or regulation.
Scrape, mirror, or systematically archive content in bulk without prior written consent.
Reverse-engineer, decompile, or attempt to extract the source code or underlying data structures of the API.
Distribute, resell, or commercialize the API itself (as distinct from applications built on top of it).
Transmit malicious code, interfere with the API's infrastructure, or conduct denial-of-service attacks.
Misrepresent the source of content or remove any attribution, copyright, or proprietary notices.
Use the API to generate, distribute, or facilitate spam, harassment, or harmful content.
6. Rate Limits and Fair Use
The free tier is subject to rate limits as published in the API documentation (e.g., requests per minute, daily call caps).
We reserve the right to throttle or suspend access if usage exceeds published limits or negatively affects service availability for other users.
Automated or bot-driven usage must comply with published rate limits and must not attempt to circumvent them.
7. Content and Intellectual Property
All content returned via the API ("API Content") remains the intellectual property of its respective owners.
These Terms do not transfer any ownership rights in API Content to you.
You are responsible for ensuring your use of API Content complies with applicable copyright, trademark, and other intellectual property laws.
You must display required attribution as specified in the branding guidelines available at https://marketing.pli.edu.
8. Your Content and Data
If you transmit any data or content to the API (e.g., query parameters, uploaded content), you grant us a limited license to process that data solely for the purpose of providing the API service.
We will handle your data in accordance with our Privacy Policy.
9. Modifications to the API and Terms
We reserve the right to modify, suspend, or discontinue the API (or any part thereof) at any time, with or without notice.
We may update these Terms at any time. Continued use of the API after changes are posted constitutes acceptance of the revised Terms.
Material changes will be communicated via email or a notice on the developer portal where reasonably practicable.
10. Disclaimers
THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED $100 USD IN THE AGGREGATE.
12. Indemnification
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the API, your violation of these Terms, or your infringement of any third-party rights.
13. Termination
We may suspend or terminate your access to the API immediately, without prior notice, for any breach of these Terms.
Upon termination, all licenses granted herein cease immediately and you must discontinue use of the API.
Sections 7, 10, 11, 12, and 14 survive termination.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the County and State of New York.
15. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and any supplemental documentation, constitute the entire agreement between you and us regarding the API.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
Waiver: Failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
